I would send the tenant a formal written notice of a renewal option and give him until X date to make a selection, sign, and return.

If electrical is in the same place, and the overall structure is the same, I doubt an inspector would claim the toilet looks "newer" than the laet permit...Either way, a formal inspection is happening tomorrow, plus a formal GC is giving me a full estimate as well.
