Welllll, don't know about NY, but if you make a counter-offer, you've given them an opportunity not to accept and possibly get out of the deal.People change their minds mid-stream all the time, which is why you don't want to give them an out.

Offer included incremental counter-offers of $500 over a other offers, up to $5,000 over my asking price.

That is assuming there are no other big issues like water damage/mold, electric wiring doesn't need to be replaced, water pipes, etc. 

@James Mcsweeney burst pipes and the subsequent damage should be covered by homeowners insurance.

We did not aim for a high price but countered to give us a guaranteed price instead, in case the appraisal comes back lower.

Get the offer out there and see where it goes, the worst they can say is no, with no counter offer.
