If an audit ever comes up - I would just mention that the LLC is required to make the payment otherwise the property would go into foreclosure; hence is it ordinary and necessary for the partnership to make those expenses(and therefore qualified to deduct the expenses).

In Illinois, this will cover the cost if they dont finish the job..But in your situation, as @Natalie Schanne mentioned, it's going to be hard to get the money.

@Guillaume Fortina yes, FHA allows 3.5% down with a multi-family unit property, and those Fannie/Freddie types you mention allow 3% down.
