If everything else is ok just make sure the first stays current, If the lender has a performing loan they would be brain dead to act now on a due on sale clause, unless there is a ton of equity and why would they waste time with it, they have other things to take care of, and even if they were brain dead you could pay off that note during the foreclosure, but there is a 99% chance that this will just be taking the property sub 2.
