Sometimes you can't even get it back if the parties involved were found to be innocent of all charges- especially if the police auction occurs between the time your property is seized and the charges are dropped.Often times it's impossible to get your property back- especially if it's something valuable like a nice car or an airplane because of the roadblocks thrown up by complicated paperwork.Drug busts are huge money-makers for police departments because they get to keep or sell everything they seize including but not limited to any cash laying around, weapons (even legal ones!)

My mentor told me at the beginning of our business relationship, "its us versus them"  in regards to tenants, I never forgot that, I am echoing here, however its very very important to note that all tenants are liars when it benefits them, professional tenants are fairly crafty, and persuasive, background checks are your number one weapons, in addition a great lease is invaluable with that said.....

It OFTEN happens, more times than you would think and as much as 50% of the time.The requirements for a righteous sale have been legislated much more difficult over the years.There are 3 notice requirements and if ANY of the 3 is deficient, it could be enough to set aside the tax sale.

If the police have a search warrant for your house, then they have the legal authority to enter the premises, often by force, but lets look at a couple common sense facts:Police are not likely to break down your door, unless they believe you may 1) have weapons 2) be a flight risk wanted on fairly serious charges 3) be hiding and have made attempts to contact you at the residence at least once before.Generally in the case of non-violent or non serious offenders, the police would generally knock and ask to talk to you.

But if she wants out, certainly allow her to do so. she sounds awful and has chosen to be the self righteous citizen IRS agent/ crazy pants.Next time, be sure to do a walkthrough with tenant before you hand over keys, perhaps at lease signing while unit is vacant, and fill out a unit inspection sheet (check the BP forms section).
