One case I read about involved the FBI, the Postal Inspectors, HUD, SEC and the Treasury Department, bringing incredible assets to bear for prosecution of related violations.The "safe harbors" you mentioned Don are "prudent lending practices".Any lender who has never made a bad loan hasn't made enough loans, it will happen and is just part of the business.

sounds like a cram down and unfortuantly unless you can prove fraud.. a loss of funds invested. and if they are crooks then same thing probably no money to get but pleasure of seeing them prosecuted.. have to remember many who brokered Trust deeds lose money as they no not what they do

The court shall order each parcel to be sold pursuant to Chapter 5723. of the Revised Code, without appraisal, for not less than the lesser of the following:(1) The fair market value of the parcel, as determined by the county auditor and as specified in the delinquent vacant land tax certificate or master list of delinquent vacant tracts, plus the costs incurred in the foreclosure and forfeiture proceeding;(2) The total amount of the finding entered by the court, including all taxes, assessments, charges, penalties, and interest payable subsequent to the delivery to the county prosecuting attorney of the delinquent vacant land tax certificate or master list of delinquent vacant tracts and prior to the transfer of the deed of the parcel to the purchaser following confirmation of sale, plus the costs incurred in the foreclosure and forfeiture proceeding.

The other thing people often overlook with the exemptions....that if the exemption is applicable they exempt you from criminal prosecution and civil liability from the government.

It may take a few months to get a solid case for prosecution and also they won’t be able to put all their small staff on that single issue but that is the proper way to deal with it.
