While its active (The 13), debtor will need court/creditor/trustee approval and my history says they won't let you buy it directly but instead, will require it to be listed on MLS to expose the property to a broader buyer pool.

I know you didn't ask and you may already know this and agree with me, but bankruptcy is a valid and great tool ( when one knows how to use it and how to optimize it's benefits ) for borrowers to research when it comes to discharging liabilities, unsecured or secured debt, or to avoid foreclosure through a repayment plan if their goal is home retention.

@Nicholas CookIt all comes down to finding the right combination (debt plus equity OR only debt OR only equity) where you and your investor are in complete agreement.

I have a good understanding of the rest of the process and don’t have any problems with the collateral portion of the loan, but I am concerned that my DTI could give me problems depending on how much rental income the will count/ what expenses they add to my debt or subtract from my income.

For example, I think we are late cycle, so I lean toward the safest part of capital stack which is debt (or debt free equity).
