For cash out refinances the borrower must own the property for at least six months prior to refinancing.http://www.freddiemac.com/sell/guide/bulletins/pdf/bll042208.pdf.Rein USA..Basically, if your lenders conforms or sells their loans to Freddie or Fannie you may need to find a new lender.

I could see it being their responsibility if the property went back to the lien holder instead of a bidder at the sale.This sort of thing must come up all the time....there must be a definitive answer

If what you can give them and still make a profit on is more than they owe then you deal with them, and close as normal.But if doing a short sale the owner must still want to deal with you.
