I'm certainly not an expert on Foreclosures in Texas, but, most residential foreclosures in Texas are Non-judical meaning the lender can foreclose without going to court so long as the deed of trust contains a power of sale clause, according to Nolo.com.

State law really affects your question regarding the collection of late fees.In my agreements for properties I own, manage, and sell with owner financing in Texas and Colorado, my agreements contain the following:Payments are first applied to any unpaid obligations such as late fees, service fees, any other associated fees, or monies owed to the Seller under this Agreement, then lastly to the lease payment regardless to notations on checks or money orders.In this way, if a late fee is due under the agreement, the agreement is in default because the entire payment was not made unless the late fee, and all other fees have been paid.Thus, you can legally evict or foreclose.Again, state law rules.
