The Operating Agreement must contain language sufficient to address IRA-related issues concerning Prohibited Transactions (26 USC 4975), The Plan Asset Rules, the allowance of subsequent or additional Capital Contributions and Unrelated Business Income Tax (including language that ensures that the Manager of the LLC will prepare and file all necessary tax forms with the appropriate taxing authorities, Federal, State and local).

And agreed on Prop 10....I think the most concerning thing is how open it leaves the rules that could get created.

Getting worried and nervous and concerned they are gonna walk out on me?

Also, my partner is slightly concerned that if he raises the rent, it may push them out and then he is left with an empty property, with the only quick option being government housing.  

I think I had a bit of beginners luck on the first one because they are great and it went so smooth. 

And since they weren't going to have those mortgage payments anymore, and the rent payment was going to be significantly lower than their old mortgage payments, I wasn't concerned at all about their ability to pay.
