They will likely in that case just build up junk debt from everywhere and go chapter 7 and blow out your judgment anyways.You need to talk to an attorney in your area on evictions.

Given that they could vacate at any time if they chose to, I don't see how making them this offer would be illegal, but perhaps I'm wrong on that.I don't know yet whether they filed chapter 7 or 13, or when the bankruptcy filing happened in relation to them being given an eviction notice (we do not have an eviction judgement though).

If the landlord is required by the rental agreement or this chapter to supply heat, air-conditioning, running water, hot water, electricity, gas, a functioning door lock or another essential item or service and the landlord willfully or negligently fails to do so, causing the premises to become unfit for habitation, the tenant shall give written notice to the landlord specifying the breach.

I think it's weird this program recommended this person as a great riskMedical debts can be more forgive-able, but my problem with this tenant is that they could still file bankruptcy and include any debt to you in that BK.Personally, I'd rather take a freshly discharged Chapter 7 BK over someone with a couple of 25K bad debts.
