If it is their primary residence they *might* be eligible for tax code 121 which would exempt some capital gains and there would be no recaptured depreciation since they didn't rent it out unless, of course, it was a rental before they started living there again.They could potentially utilize a 1031 exchange if it is a rental property, but that is a complicated process and one I can't really comment on in a post.

As long as I follow the Texas property code and keep all the books separate as @Costin Iorgulescu mentions, the code should provide protection for those new LLCs.
