The KEY in this verbiage is the word "AND" - if it had said "OR" subsequent conveyance, then I think there is an issue, but so long as you don't negotiate the sale - hire someone else (3rd party who will follow the rules of this state - OR a Realtor to negotiate it for you) and you purchase take title and resell it to a 3rd party (not the original homeowner) you are complying with this law.AGAIN, I AM NOT A LAWYER, but you are not doing an Equity conveyance as you're not intending to let the original homeowner live there.

You have to check with the laws for your State.I see this happening a lot lately - the owners were not properly notified.Unfortunately it takes money and a lawyer to go after the lender for this negligence and to prove it, therefore since most of these owners lose properties in foreclosure because of money issue, it is a catch 22 situation.They don't have the money to pursue litigation, therefore they might unjustly lose the property.
