At that level of court, you aren't getting the best qualified judges, and sometimes they follow their own law instead of what is in the law books.Whatever happens, wait patiently for your first legal opportunity to get rid of your parasite tenant.

Folks, please be very cautious of taking advice from a poster on BP with such a huge negative influence level and from somebody who has such a limited amount of contributing activity to the site over a long period of time.Add to that the due diligence that has uncovered the original posters inability to make wise investment decisions, you should be very cautious as to what advice you take from such a person.

I would like to add that the property (land) would be appreciating, and even if it's just keeping up with inflation, the return would be 8.1% after inflation, which no money manager would claim to match, especially with inflation at current levels.

I am a land development planner out of Tucson, Arizona and in my experience the likelihood of getting a rezoning approved has a lot to do with the level of support from the jurisdiction and surrounding land owners.

Many of them are near or underwater, and their loans are coming up for adjustment at the time the kids are going to be going (or should be) off to college.
