If you collect rent after the termination date then it restarts the tenancy and the tenant can file a motion with a judge at which point your case will be dismissed.So if they were served a Notice to Cure on Jan 2nd, they would have until the 12th to fix it.

Usually you want a CMBS loan to only have fraud and bankruptcy as recourse provisions (very narrow instead of broad).When an assumption is done you can waste 6 months and not get anywhere.
