Should an HOA be allowed to give credit to owners that are able to participate in a clean up day exempting them from a special assessment while assessing the rest of the owners that do not or, more important, cannot participate (whether they have to work on that day or are disabled)?

Another possible tack is that the association sues you for an injunction (that would require you to fix the roof); or, they may (depending on the governing documents) replace the roof for you and levy a special assessment on your property to cover the cost.

Marie Poe the insurance companies in Ohio are regulated by code section 3929.86 (c) which specifies when a loss equals or exceeds sixty percent of the aggregate limit of liability on all fire policies covering a structure the company shall transfer two thousand dollars for each fifteen thousand dollars of the claim to the municipality in which the structure is located.
