If a buyer knows the FHA health and safety guidelines to the tee they could in essence team a maintenance crew and loan officer (as an advisor) up to do the "minimum," amount of work during the escrow period prior to the FHA appraisal (assuming min repairs) being conducted and potentially close with a standard (non 203k) FHA loan.

The reason you may want to do it anyways is to create self employment income to take advantage of the deductions for self employed health insurance and some retirement plan types.I will also note that an entity doesn't have to show a profit after 3 years to be a business - that is just one consideration in the facts and circumstances test.

if I perceive the "request" to be a veiled threat, depending on the circumstances, I might say, "that sounds like it might be a safety issue (or health hazaard), you might need to move out so I can remediate the problem, I'm going to see when I can have someone out there to check on that...
