but most likely it will be fine.. 12 % interest for this risk.. in my mind is only being done by very naïve investors or friends and family wanting to do a solid for this guy.. that's my thoughts.The reason most lenders do not allow seconds behind their firsts is it precludes the ability to take a deed in Lui it forces senior lender to full blown foreclosure if the second wont just go away unpaid..

I haven't heard any high mucky mucks say anything, but eventually someone is going to realize that they can invoke DOS on all these peeps with borrowed money at 4.5% or 5%, when current prevailing rates are back to historic norms of 7%, and force them to refinance (at 7%) or pay the loan back (so the money can be re-lent at 7%).

Because it seems excessive to you doesn't mean it won't hold up in eviction court.This clause doesn't take advantage of anyone and no one is forced to live under these rules.
