Not sure how to structure the deal: Is it a lease option or Subject 2 Home needs some renovations and I would like to buy it and flip it: I would like for them to hold the mortgage ( would I make the monthly payment $1300.00), pay 12K cash so they can move on, do the repairs $43K and then be able to sell the house.

(no eviction process, but make sure it's legal in your area) You also want to have it so that they are subject to random drug testing.Another way to go is to offer some type of rehab where tenants are required to participate in a 12 step program, have meetings at the house, counselors, etc. where there is more time involved, etc. and therefore; higher rates.

Not my area of expertise but my understanding is that the winning bidder at the foreclosure auction is the owner subject to the 1st mortgage.this is probably subject to state law but generally the 1st has to accept you as the new borrower.

But always, I was respectful of them and of a tough situation, offering honest solutions and we both benefited.I now do "Subject To" instead, with Joint Investors, because it is far less risky, it is more profitable, less work and a much faster way to wealth with a $25,000 investment instead of the $200,000 and $300,000 I had to use in the market I was in.If you choose to do Foreclosures, my method works great, but find out if it is even still legal since the changes of 2011, and 2016.

Do a search for similar subjects, but as I recall, you probably need to hold it as an investment property for at least two years before undertaking a 1031 exchange.
