Add "all others in possession" or Jon Does 1-10 & Jane Does 1-10 to include all those other people living there who are not on the lease.3.

If they have already sold the property and have the sale proceeds in their possession, then it is too late for a 1031.  

I mean, what tangible value would it have compared to a “paper” US dollar, or a piece of gold, or a loaded gun in my possession?

If I lived across the street and saw a potential gain by acquiring that mower then I would have immediately walked up the driveway, knocked on the door and taken possession of the mower.I then started to think of all the opportunities lost by real estate investors because of questions unasked.  

@Mindy JensenI had one started back in January in Florida and the judge issued the writ of possession but Sheriff called me to say that they could not post it.

Once possession is taken, the fee becomes the security deposit.
