This is a very popular business model right now, companies like Locale (they are pretty well known here in TX) and Lyric (who just raised 100 million from airbnb and other investors) are doing this exact thing and making a ton of money.

From what I've read on the Biggerpockets Forums in the US section, an LLC is the most popular for the liability protection, and the tax structure, and has less accounting headaches than a C Corp.

So, while this is a popular transaction, it is not what I would call creative at all since it's only an assumption.

Condos are very popular in big cities .. yes u pay HOA …but it works like an insurance ..provided nothing goes wrong inside ur apartment …u sleep well .. tenants call you ..pipes are backed up …”call HOA I am out of town, bye” and I am AMAZED how easy it is so far…all I do is collect rent …yes it’s my 2nd year of operation but so far no problems at all.
