Nonpayment of rent is not a defense for anyone including handicapped people.

You could try but I hope you have a good defense you can give the judge and hopefully you have enough money saved to cover your move and your court costs/back rent.

In Sue's defense, Chris, you never mentioned the $70k balloon note at the end of term. 

Thanks for the advice; I was somewhat surprised to see such a disparity in opinions on this.After reading this I was prepared to cover at least half $52.50, or maybe even the whole $105, but I was able to get the tenant, myself, and our bank on a conference call today where they dropped all the overdraft fees.  

Orcale and other companies moved their conference for that reason too. 

Of course, in the papers' defense this is becoming fairly common.  

I posted links to specific California laws and suggested she confer with a lawyer, but only response from OP has been asking if it is legal to put in a lease.

For example, their response to some clarification that I requested seemed defensive.  

Sure you can , make sure you save enough legal fees ; defense attorney are not cheap
