Obviously, you can't discriminate against protected classes, but how would a tenant claim that you denied them based on, say, familial status rather than the fact that you just didn't like them, or they seemed messy, or whatever?

Additionally: whatever you do about this, try to stick to email (other written communication) that you can later go back to in case the tenant decides to claim that he was not fully reimbursed.(1) Ask the former owner for any Lease he had with this tenant (it sounds like you were this tenant's landlord for 6 days - I'd ask for this document during the purchase period.)

You will be better served by completing the 1031 in your names and then after the fact contribute them into the LLC.

I would try texting the listing agent - she's had this property listed on and off since 2008 and has been dealing with the short sale (what a pain for an agent) - she's probably sick of it, not making any money on it and has probably been fielding a million calls from completely unqualified first time buyers who want that area but don't really pay attention to the details and don't have any cash - I would be clear in your communication with her that you understand the requirements and have the cash to close - I've had transactions with her in the past she's been around for a long time.
