You can be held liable either way, but if you didn't pull permits when it's required you'll pay additional fees and penalties, and in many places they can shut down your project until you bring everything up to their standard.

I would highly caution you against doing this because at any point in time, your rental income in the property could completely be shut off.However, there is another market where STR's are currently thriving, and that's Cape Coral, which is about 45 minutes to an hour North of Naples.
