What I understood this to mean, is that if the tenant never moves in, they have forfeited their holding deposit FEE BECAUSE THEY BREACHED THE CONTRACT, because the only way to ever get it back, would be if they moved into the unit AND FULFILLED THE TAKING POSSESSION PART OF THE CONTRACT THEY WILLFULLY ENTERED INTO, THEN THEY HAVE A FULLY FUNDED SECURITY DEPOSIT.

The guy who has a drug possession charge from a few years back that he pled no contest to because he couldn't afford bail and needed to get out of jail to get back to his minimum wage job to support his kids, he has a good chance of being fine.

We received the prorated amount for the time from when we took possession, but our offer had been based on the higher rent.So far it has worked out well for us, but we almost always have seen every apartment before making an offer.

I still plan on proceeding with the court hearing to get the judgement ... but my question is this: Can I take back possession of the property now?
