It requires getting a rent schedule to document it.

My recommendation is that you completely move into the property, change your address on all documents, and live in the property for a year before deciding to make any change.

Either way, start documenting the problems you are having and charge the tenant for the damages. 

If you can document that you have lived in it for 2 out of the previous 5 years then you can exclude the gain from this allocation  (approx what - 20%???)

I believe you or your tenant could possibly have a real good case of discrimination or harassment .Another thing would be to take pictures and document all the other violations in the community request that all be fined and corrected .
