An attorney will generally draft the note and then it would be signed and recorded against the collateral property and you would receive the funds due to you.

I understand I might be responsible for mechanical liens or back taxes or past due HOA assessments but I have a hard time to understand if I might be responsible for other mortgages as well. in the attached picture you will see the flow of recorded documents. asking attorney to do a title check for every property is not possible. the below is public information that can be looked up by anyone

I don't do driving for dollars but I always thought if I did I would run addresses through records to make sure I was mailing the owner.You might get 1 out of 50 offers accepted so keep on the grind.

The lender paid expenses include Sheriff Costs, Appraisal Fees, Property Inspection Fees, Foreclosure Fee, Title Exam, Certified Mailing Fees, Posting Cost fees, and Recording of the substitute trustee.

It's one thing if it was disclosed from the beginning that work was still ongoing and would be finished in a few weeks, but that wasn't the case.Just for the record, the person marketing the property was not the flipper himself, but a realtor / property manager.

To me this is a win/win, this saves me the time/money to have a sheriff come out, it gives him an incentive to not put a sledgehammer through walls, or cause damages, and to him, it prevents a judgement on his credit report, it saves him hundreds of dollars in a judgement, and possibly even will prevent, the eviction from coming up on future landlord screens(which is something I don't like, as these type of people and their actions need to be public record).Thoughts?
