@Matthew Powell yes you can transfer the property but if you have a loan be aware of the dreaded due on sale clause and look into it further if that is a concern.

When I have a property that is mixed smoking/non-smoking, we discuss with prospective tenants to make them aware that the property is transitioning to non-smoking, that it is in the rental agreement that there is no smoking within their unit or common areas, but acknowledge that there may be smoke on the premises in other units.

@Brian Crowe There are two kinds of water accounts:Lienable and not lienable.Not lienable are on the tenant.The ones that you are talking about are ones that are lienable, usually if you deal with tenants you should be aware of it and put the utilities on the property name and charge the tenants separately for it.Just pay it and take it as a learning experience, it will be a waste of time suing the tenants.
