That would outline the terms of the lease - rent, security deposit, property condition at move in, lease end date, lease term and anything else that a lease should cover.

The broker can chose to terminate the contract or the seller can but even in this case many will still require payment if the home is sold during the timeframe the listing agreement outlines. 

Any reasonable MF broker knows the expectations outlined above.

You would absolutely create legal docs that outline the expectations of the loan and the repayment.

of @Joshua Dorkin  I also think it is due to some lack of a plan (outline).

I am outlining this under the assumption that the owner is unaware of the problem, as the tenant is dealing directly with the management company, and the management company is telling the owner everything is "fine and dandy."
