Having said that, there is nothing to stop two arms length consenting parties from agreeing to arbitration / mediation (I define Mediation as a third party trying to bring the two sides together and Arbitration as agreeing to empower a third party to hear the two sides 'informally' and be bound by the arbitrators decision outside of the court system).
