Put your money into fixing the problem rather than wasting it on a lawyer.The problem is caused by poor air circulation and moisture build up likely caused by the tenants.

The state largely waived the fine in exchange for a write up of what the person had been doing and that write up was then circulated.

Bleed the radiators so all are functioning and make sure the pressure is up and setting is proper on boiler, you could have a air lock keeping the water from circulating the way it should up to second floor.

These are still ducted but need to be installed on an outside wall to circulate air in from outside.If you do use a ducted system, make sure that the air handler is not installed in an attic.
