Originally, this was intended for first-time home-buyers, but somewhere along the way things relaxed and a 5% down payment is available on the purchase of your primary residence (which, by definition, is owner occupied).

If anything, IMHO, the gift rules should be relaxed so that "borrowers" could get whatever help they needed to in order to have 10% or 20% down.
