I believe the judgment was for $45 MM, whereas the LLC only listed assets of $1 MM, so there is a very limited loss, especially to Kyosaki who's personal holdings are protected since the LLC engaged in the business activities and BK.Long story short, BK doesn't build wealth.

I would not engage a lawyer.  

My only other concern is that this deal will likely get dragged out for months and months, so I run the risk of tying up EMD forever, but I guess is not much different than engaging in a short sale.  

Especially with really coarse paper having the drum engaged when still WILL result in a groove in the floor that you will NOT get out.

If you bought the property all cash, you will engage lenders and explain you're looking to cash-out refinance and they will guide you through the steps.

Hi Cassandra,I'm happy to discuss some of the options with you (currently working on multiple 1031 exchanges throughout San Diego County) but this is very critical and you should engage an exchange accomodator before thinking about your 1031 exchange to make sure everything is done properly and you don't end up with an unexpected tax liability.

Typically your avenue for dispute would be on their policies and within the engagement agreement.For those small dollar amounts, I can't think of a cost effective avenue aside from a discussion with the attorney.The prices are within the range I would expect, give or take more information on the situation.
