To be honest I'm not entirely sure what to call it, but a note seems appropriate.The note holder has a property set up as a rent-to-own, but the terms require the renter to be responsible for all repairs, taxes, and cap-ex.

Reach out to a real estate attorney right away Although to be honest I’m not sure they can do anything for you at this point.Rule #1 when buying a foreclosure sale is do a title search and be sure you are purchasing it from the first mortgage holder.

This is true, but if you control the lien, that lien control allows the lien holder to foreclose, thus getting the property instead of the cash back from the loan.
