If he stops paying, you evict.You might be able to insert an "assignment of rents" clause in the lease that would give you the right to directly collect any rents from his subleasees if he fails to pay.

The very first time that the tenant fails to pay toward the past due balance, I would start the eviction process.What's very likely to happen is that the tenant will do ok for the next two months and then will have more excuses (and no rent) in December.

Here in the Show Me State (Mo.) we too are a deed of trust state and you can stipulate conditions, but there is a $5,000.00 minimum for a mortgage and many Realtors who carried back commissions who tried to collect through foreclosure, failed.
