My listing agreement says, (quote), "Said commission being due and owing by Seller upon the successful sale of the Property or when Broker produces a ready, willing and able purchaser of the property regardless of when closing occurs [...] 

In my opinion, a track record of success and self confidence make the difference in negotiating favorable terms.

I am more interested to know the operational and legal ramifications of this set up though if this model is successful to improve the cash-flow and the value of the building in min 5-year time frame.
