Guy, an interesting read, but I totally disagree that the solution is more government regulation or  oversight of rental properties - unless they are part of section 8 and are therefore offering a service in exchange for income.IMO, the answer to your question of "When would you know....." is more based on personal integrity and ethics than a hard or fast "model". 

Primary residences have a totally different set of rules and regulations as to how you handle default and foreclosure.

Of course many states have slightly different regulations but in your city does a quit claim activate the due on sales clause.

If there are solid procedures in place for bookkeeping it can be a relatively smooth yet necessary evil. 

If you aren't 100% comfortable with how it works, and you're in a tenant-friendly market (i.e. more complex procedures), then you should work with a housing attorney who knows the process. 

The industry was not regulated until the loan fraud became an issue requiring a license(s).

Also, depending on the HOA, there may or may not be regulations affecting when/how you can rent out the properties.
