Regarding terms, I got to call the lender Monday to find that out.I'd like to mention that the reasons why I don't want to lose this deal is because the property comes with instant equity and also has an apartment attached to the house.The other option for me is to forget about this deal and buy out of state were I can pay cash for a house.Thanks for you imput Jon and If you have more advise for me I'm here ready to learn.

Hence the difference between practicing real estate, and selling something you have an interest in, your name must be attached to that property(via legal documents i.e. the PSA) in order to sell it.Also just point her here to BP and she can read the hundreds of threads dealing on the legal aspect of wholesaling.

Just another drawback to CFD, is the fact the seller can still encumber the property even further voluntarily, or have have liens attach and then be unable to come up with the money to cover everything and can't close at you contract price.
