Since the deal wasn't direct (there was a wholesaler involved) and she was allowed to stay in the house for some length of time after sale, and presumably she didn't have a real estate agent or attorney representing her, her claim would be considered by the court as her being taken advantage of.

The escalation clause should include language that says something like "Offer amount will be increased by $5,000.00 over a bona fide, arm's length offer up to a maximum of $930,000.
