I'm explaining the situation so others can give me their feedback, advice and suggestions.If he's charging me a fee for possessing a license, that seems out of line to me, not to mention if that is truly the case, he's already collected that fee once for this project.

I realize that an occupied foreclosure requires the buyer to evict the current occupants in order to obtain possession, so I am wondering if Cook County is better about evicting tenants when the property is foreclosed/sold than if the original landlord or lien holder is trying to evict the occupants.

I would delay possession of the property until it is vacant; do you really want to take over a property and need to complete an eviction from the beginning?

(Thanks, Business Law with UCC applications, 13th Edition ;)) I think this portion of the law is what you're most concerned with as I'm of the opinion that your contract offers consideration (a house for money), you're legally permitted to assume that the other party to the contract possesses the capacity required, and I'm just assuming that there is nothing illegal about the exchange.Assuming your offer was in writing (real property contracts require writing), and you appointed your agent in writing, and your agent made the offer on your behalf (or you made the offer directly in writing), AND your contract spelled out clear and reasonably definite terms, AND it was signed, witnessed, and delivered, I would say you've got pretty good grounds to pursue the contract.

I'm also working with the current owners to find a place to finance for their niece.Lessons learned:You make money on the buy, not the sale; be more thorough on inspection and don't be generous regarding fixes before you take possession of the property; I still like holding notes instead of being a landlord; there is a price for your time.

Got the judgment and tenant was ordered to vacate the premises last Thursday.The tenant is still there and the elderly lady's son wants her to change the locks and not file a Writ of Possession.
