What I would do is have something in writing as part of the offer that my bid is based on the systems in working order (or some estimated life span left)We will spend $30k to inspect them all and if any are deemed required to be replaced we will credit X at closing.

I did find a local 203k consultant that I plan on reaching out to to help through the process.

If someone has participated in the process of investing in a proposed development before and could shed some light on how I should approach this that would be great!

I think a couple of things you could do....stay with same title company, but ask them to write it on different paper that will allow you to do what you want to do.

I would have the conversation about these things beforehand so you are on the same page and then I'd write it all down so you are both in agreement.

However, I think the prices in California will cause us to invest out of state and we will just have to learn how to set up the right systems and processes to deal with issues as they come up.

How was the process...was it much more difficult than constructing on a normal lot?
