That closing agent can provide the title insurance for both the AB and the BC because they know they will be recording AB and then BC in the proper order, and be able to confidently provide the title insurance commitment that indeed you ARE the owner of record at the time the BC transaction closes.If the C Buyer says that they want to buy it directly from A, tell them that would be impossible because you are already under contract to close on it.

and continue paying for the mortgage on the first house whilst the second house sorts it self with rental.really what i am asking here is where does one live after their first investment purchase. do you rent somewhere else and buy your first house for rental?

I am 100% confident you will run in to this.The easiest way to avoid these arguments is to get a full appraisal done prior to discussing an offer with them.Summary:1. get an appraisal if selling to the tenants or at the very least a full CMA with on site visit- not a drive by2. sell as soon as you can if you can get your money out of it you want3. be prepared for lower offers from tenantsDoes all this make sense?
