ya i dont think there is a seasoning issue with refinance.. but if a partner wants out and cash's out I think that could easily be classified as a sale and all tax is due just like the 1031 never happened int he first place.

I may have been a 'consultant' for another's property before.To fully be classified as a 'property manager' which requires a license if you don't have an ownership interest, a few key things need to not be among your services rendered.I didn't place anybody without owner approval.

If you are looking to be classified as an accredited investor the SEC doesn't really come to your house and invade your closets so if it looks legit on paper you're probably ok but again always seek the council of licensed attorneys
