Eviction is more expensive for you, could take a lot more time if the tenant decides to fight you in court, and the tenant may win the court battle, not you.

The neighbor indicates this can go for all day, sometimes from 8 am till 5pm, and she has tried to communicate this to my tenant but my tenant responded that this is a personal matter and the neighbor should not be inquirying about it, and if she continues she will take her to court.

I would definitely have an attorney read the original lease and see what their interpretation is of which outside space belongs to which unit.I would continue to serve him the three day notices and if he does not comply then you have a chance to go to court and try to evict him.

I know here in TN it is taking a little while to get a court date so I do not know what it looks like in TX right now.

Have a tenant who won’t pay rent changed the locks won’t get out etc in the Philadelphia area courts super backed up any advice from someone familiar with Philadelphia area 

When it goes to court (and it will) and the judge finds out that you knew you were renting an illegal unit, you will have more to worry about than making a few bucks.Just my .02.

The lease I use is a mature document that has been improved every year over the last decades based on issues that came up, after every major court case in Wisconsin etc.

How about the call that the heater or AC is not functioning.  

If I'm reading this correctly, this is a serious mistake on your part and you could be sued for specific performance, meaning that a court will force you to honor the terms of the contract.
