You might have to do some dialing for dollars to find a local lender familiar with this guideline (& you don't want to be in the position of trying to teach your mortgage lender how to do mortgages...), but if that's the only wonky thing at play, it can be overcome without going hard money.EDIT: Note that mortgage guidelines on cash out refinances are riddled with "Except for cash out refinances in Texas, where..." so rope in a lawyer in Texas to tell you about if whatever follows "..."
