I'm with my friends a lot them are lawyers, most them real estate or corporate and it will come down to many and states enforcing what we bother cosdier BS, will lose business to the other state or city. 

The irrevocable trust conforms to Utah Code 25-6-14 as well as Internal Revenue Code 541(c)(2) and is considered a restriction on the transfer of a beneficial interest of the debtor in a trust that is enforceable under applicable nonbankruptcy law - and thus, said restriction is enforceable under federal bankruptcy law.  

This does not preclude having an agreement whereby the filing of bankruptcy will or can accelerate enforcement of other agreements, like the termination of the agreement or the right to accelrate amounts due to maturity.While you should not dispose of any asset in contemplation of bankruptcy, many times something can be worked out within the family.

I know in Weber County Ut  where I live it is against the zoning to rent for less than 30 days but they don't enforce it. 

The key is to be clear as to what you need, put it in writing in the rental agreement, and enforce the rental agreement throughout the tenancy.

I'm all for enforcing your own rules, but I certainly wouldn't keep charging her $40 a day because she was $5 short.

The only illegal  nature would be if you are knowingly harboring a fugitive (wanted by law enforcement, not just being in country illegally).

Don't delay either; being swift to enforce the terms of the lease agreement and to attend to maintenance and repair needs is important.
