Your evidence of the contractor's poor work ethic is minimal and circumstantial at best.

Before selecting a business like real estate, or any business, check yourself out, what are your ethics, what do you believe business is?

Do not hesitate just replace the hardwood with treatment on subfloor.

What matters is that the account is opened in the name of the 401k and that the plan's EIN is used for reporting purposes, and yes a 401k falls under the trust umbrella because it is afforded favorable tax treatment.

As pointed out by the prior comments, if the asset does qualify for 1031 tax treatment, it is likely their will be specialty assets that promote the fact that they are 1031 Compliant as their goal is to secure as much exchange money as possible.
