What matters is that the account is opened in the name of the 401k and that the plan's EIN is used for reporting purposes, and yes a 401k falls under the trust umbrella because it is afforded favorable tax treatment.

As pointed out by the prior comments, if the asset does qualify for 1031 tax treatment, it is likely their will be specialty assets that promote the fact that they are 1031 Compliant as their goal is to secure as much exchange money as possible.
