Hardly... the tenants and their lawyer are playing games.Were I the auction purchaser in such a situation I would leave emotion out of it, give the appropriate notice to quit, and on the first possible day file to evict and obtain possession.

The bank took possession and then eventually dropped the price to 75k, which I negotiated down to $58k.So the final price is $58k (plus $3k in closing and etc) for 900sf which will rent @ $700 a month.

Then go over and back up the sewer in their unit, then take the electric meter off the house, and play dumb, then he tells me to install a siren in the basement pointing in to their apartment and set it off at 2am and leave, and play dumb, then he says the best way is to jump 220 to all the 110 outlets and all their possessions will be ruined.

We also have occupants sign an agreement saying they are giving up possession and all rights to the property in exchange for the cash for keys.

It can be done under agreements that can vary from having the first tenant being held responsible, as in the case of simply sub-letting, or the owner could agree to only hold the tenant in possession,which is not so likely.
