The tenants will claim stuff was present at move in and you need to have document of the condition at move in to prove yes/no..... otherwise its a fresh start now and you eat the damage they did before you owner itGet your lease in order and give it to them now, so they know what it will be when its time to renew.....

The fresh paint smell gives new applicants the impression that the place is in good shape, too.I'd charge a reasonable fee for getting the garden in shape, as that was their responsibility.At any rate, that's what I think is fair.  

If this tenant is fresh out of school then he really hasn't had a chance to build a credit history.

Just say you'd rather start fresh with your own tenants and you don't want to be tied in with a lease, and/or that you may want to refurbish the unit or just whatever.
