I counter back at him saying that BOA would never pay me or accept the CC to used as LM fee and suggested to ammend the PA insert the CC in it and get rid of the verbiage about LM fee.In a separate agreement (off the HUD) the seller will be responsable to pay me whatever amount he is getting as cc.

It is correct that even if you had deposited the earnest money, it would go into an escrow or trust account and refunded to you at any time before the short sale was approved, or after if you inserted a contingency as the buyer due to financing or inspections ect.In addition, any time an offer is signed by the seller and the buyer (considered a mutually accepted offer) the listing agent is required to change the property to pending.

I don't really like to have significant funds not drawing interest in the hands of anyone even my best friend.Lawyers hate the paperwork for a 1031 exchange but they must be on board before the contract is let for the relinquished property so language is inserted notifyin g the buyer that there is a 1031 exchange involved.
